Business Valuations for Family Law Matters

Independent valuations of businesses, shares and trust interests for property settlements, prepared so both parties and the court can follow the reasoning.

  • Independent value of businesses, shares and trusts
  • Single expert, party expert or shadow roles
  • Report written to be tested

What we do

We value business interests held directly, through companies or through trusts, as at the date required by the matter.

We can be engaged as a single expert, by one party, or in a shadow role to help a legal team understand and test another expert's report, where permitted.

Reports explain the method, assumptions and information relied on, and identify where missing records limit the opinion.

Issues that often complicate the work

  • Business income versus personal benefit

Owners may draw personal expenses through the business or take a salary that does not reflect market rates. These affect both value and the parties' financial picture.

  • Personal goodwill

Value that depends on one spouse's skills or relationships may be treated differently from goodwill that would transfer with the business.

  • Trusts and related entities

Interests are often spread across companies and trusts with loans between them. The structure needs to be mapped before it can be valued.

  • Incomplete or disputed records

Where one party controls the records, we identify what is missing, what can be reconstructed, and how that limits the opinion.

Our approach

  • Confirm instructions, the valuation date and the interests to be valued with the instructing lawyers.
  • Map entities and inter-entity loans before valuing each interest.
  • Normalise earnings, assess personal and transferable goodwill, and value each interest.
  • Set out the reasoning and limitations clearly so the report can be tested.

Our role is to give an independent opinion on value. We do not advocate for either party, and we do not advise on how property should be divided.

Questions people ask

Questions we are often asked

Can you act as a single expert?

Yes, where both parties agree to the appointment and the instructions are settled. We first check for conflicts with either party.

What if the business records are incomplete?

We identify what is missing, request it through the proper channels, and explain how gaps affect the opinion. Where funds or assets need tracing, see our forensic accounting services.
